1 Overview
StepFixGuide respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), we will respond expeditiously to claims of copyright infringement committed using our website.
Important: This process is reserved exclusively for copyright owners or their authorized representatives. Before filing a claim, please consider whether the use qualifies as fair use, as the DMCA process may not be appropriate in such cases.
2 Filing a DMCA Notice
If you believe that content on StepFixGuide infringes upon your copyright, you may submit a written notification (DMCA Takedown Notice) to our Designated Agent. To be effective, the notification must include all of the following elements.
3 Notice Requirements
Your DMCA notice must include the following information:
- Identification of the copyrighted work — A description of the copyrighted work you claim has been infringed, or if multiple works are covered, a representative list.
- Identification of the infringing material — A description of the material that is claimed to be infringing, with enough detail for us to locate it on our website (URL preferred).
- Your contact information — Your address, telephone number, and email address.
- Good faith statement — A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
- Accuracy statement — A statement, under penalty of perjury, that the information in your notification is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.
- Physical or electronic signature — A signature (physical or electronic) of the person authorized to act on behalf of the owner of the copyright interest.
Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be liable for damages. Please consider this before submitting a notice.
4 Counter-Notification
If you believe your content was removed by mistake or misidentification, you may submit a counter-notification. Your counter-notification must include:
- Your physical or electronic signature.
- Identification of the material that was removed and its location before it was removed.
- A statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification.
- Your name, address, and telephone number.
- A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located.
5 Repeat Infringers
StepFixGuide maintains a policy of terminating, in appropriate circumstances, the accounts of users who are repeat copyright infringers. We also reserve the right to limit access to our website for any user who infringes upon the intellectual property rights of others.
